TERMS OF USE & PRIVACY POLICY
1. Parties and Definitions
This agreement is between the Finly platform ("Platform") and the user registering on it ("User"). The Platform is a digital environment that brings aquarium hobbyists together, providing only technical infrastructure and intermediary services.
2. Platform Role and Disclaimer
Finly is a technology intermediary only. The Platform is not a party, guarantor, representative, or mediator of messages, content, trades, offers, or agreements between users. The Platform does not verify, approve, or guarantee the content, accuracy, reliability, or legality of such transactions.
3. Marketplace Transactions
All buying, selling, trading, and offers in the Marketplace are solely between users. Finly accepts no legal responsibility for product quality, delivery, payment, fraud, or contract breaches. Any disputes or losses between parties are entirely the users' responsibility. Users must verify the other party before transacting.
4. Messaging and Communication
All private messages, comments, and communications between users are entirely the users' responsibility. The Platform does not monitor or review communications and cannot be held liable for their content. Users who produce illegal, threatening, harassing, misleading, or harmful content are solely responsible under applicable law.
5. User Content
The user who uploads photos, videos, text, comments, and other content to the Platform is responsible for it. Finly does not pre-screen content before publication. Uploading content that infringes third-party copyright, trademarks, or intellectual property is prohibited; any legal claims arising from such violations will be directed solely to the relevant user.
6. Prohibited Content and Conduct
The following are strictly prohibited: (a) Sale of illegal goods or services, (b) Posts that violate local laws regarding live animal trade, (c) Harassment, threats, or discrimination, (d) Attempts to damage platform infrastructure, (e) Spam, misinformation, or fake accounts, (f) Content harmful to minors. Accounts violating these rules may be suspended or permanently closed without notice.
7. Privacy and Data Use
The Platform collects basic user information (email, profile name, region) required for operation. This data is not sold or rented to third parties. Users have the right to request removal of their data upon account deletion. The Platform may analyse some technical data anonymously for security and continuity purposes.
8. Service Continuity and Changes
Finly does not guarantee uninterrupted or error-free operation. The Platform reserves the right to suspend, modify, or terminate all or part of the service at any time without notice. The Platform cannot be held liable for data loss or access interruptions resulting from such changes.
9. Age Requirement
You must be at least 13 years old to register and use the Platform. Accounts for persons under 13 are prohibited.
10. Limitation of Liability
Finly is not liable for direct, indirect, incidental, or consequential damages caused to third parties or other users by user actions on the Platform. The Platform's legal liability is limited in all cases to the amount paid by the user to the Platform (if any).
11. Governing Law
This agreement is governed by the laws of New Zealand. New Zealand courts have jurisdiction over any disputes.
12. Acceptance of Terms
By registering or continuing to use the Platform, you declare that you have read, understood, and accepted all of these terms.
